Sen. Josh Hawley, R-Mo., plans to introduce a measure in the Senate to dismiss the impeachment charges leveled against President Donald Trump. Hawley’s measure to dismiss is based on the lack of prosecution that proceeded the case in the House of Representatives.
“Dems said impeachment was urgent. Now they don’t want to have a trail, because they have no evidence. In real world, if prosecution doesn’t proceed with case, it gets dismissed. So on Monday, I will introduce measure to dismiss this bogus impeachment for lack of prosecution,” Hawley tweeted.

In short, Hawley is claiming that the Democrats’ failure to move forward with the case makes it subject to possible dismissal. In traditional civil cases in a court of law, this is known as a failure to prosecute and results when a plaintiff “unreasonably neglects” to proceed with a case or causes unreasonable delay in doing so.
Hawley said his proposal will also adjust the Senate impeachment rules for future Senate impeachment trials.

The actual motion has yet to be released. Nonetheless, Hawley’s reason for initiating this motion is to expose the fraudulent impeachment process for what it really is.
“This will expose Dems’ circus for what it is: a fake impeachment, abuse of the Constitution, based on no evidence. If Dems won’t proceed with trial, bogus articles should be dismissed and Donald Trump fully cleared,” Hawley tweeted.
House Speaker Nancy Pelosi refuses to send the articles of impeachment over to the Senate, until she gets what she deems to be a fair trial. The actual case for impeachment has little evidence and is ultimately a disaster for Democrats. Hawley’s measure is not just a way to expose the smear campaign against Trump, but it will hold Democrats responsible for obstructing the impeachment process.
